Seller Terms & Conditions

1. Platform role

We provide an online listing and discovery service only. We are not a party to any transaction between buyers and sellers. We do not take possession of items, process payments, guarantee authenticity, or provide escrow. All sales, payments, delivery, and disputes are solely between users.

2. Eligibility

You must be at least 18 years old and legally able to enter contracts in your jurisdiction. You represent that all information you provide is accurate and that you have the right to sell any item you list.

3. Your listings

• You are solely responsible for listing content, photos, pricing, and communications.
• Items must be legal to sell in your province/country. No stolen, counterfeit, or prohibited goods.
• We may remove listings or suspend accounts that violate these Terms or applicable law, without notice.
• We do not guarantee visibility, ranking, leads, or sales.

4. Fees

Access may be offered free of charge at our discretion. We reserve the right to introduce fees in the future with reasonable notice. You are responsible for any taxes arising from your sales.

5. Account inactivity

Seller accounts with no login or listing activity for 60 consecutive days may be deleted automatically, along with associated listings and data, without compensation or prior notice.

6. Disclaimer of warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE SERVICE.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCARLETT STUDIO, ITS OWNERS, OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE PLATFORM, ANY TRANSACTION WITH ANOTHER USER, OR ANY CONTENT YOU POST — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) CAD $50 OR (B) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.

8. Indemnification

You agree to defend, indemnify, and hold harmless Scarlett Studio and its owners from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your listings, your conduct, your breach of these Terms, or your violation of any law or third-party rights.

9. Disputes between users

You release the Platform and its owners from claims, demands, and damages of every kind arising from disputes with other users. We are not obligated to mediate or resolve disputes.

10. Privacy & data

We may collect account, usage, and security data as needed to operate the service. We may share information when required by law or to protect the Platform and users.

11. Changes

We may update these Terms at any time. Material changes may require re-acceptance for continued access. The version shown at signup applies to your account.

12. Governing law

These Terms are governed by the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of courts in Saskatchewan for disputes with us.
